FBI And Other Agencies Paid Informants $548 Million In Recent Years With Many Committing Authorized Crimes

Federal agencies paid out at least $548 million to informants working for the Federal Bureau of Investigation (FBI), the Drug Enforcement Agency (DEA), and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), in recent years, according to government audits.

  • A few informants became millionaires, with some Amtrak and “parcel” delivery workers making nearly $1 million or more.
  • Many informants were authorized to commit “crimes” with the permission of their federal handlers. In a four-year period, there were 22,800 crime authorizations (2011-2014).
  • The FBI paid approximately $294 million (FY2012-2018), the DEA paid at least $237 million (FY2011-2015), and ATF paid approximately $17.2 million total (FY2012-2015) to informants.

Our auditors at <a href="http://OpenTheBooks.com" rel="nofollow">OpenTheBooks.com</a> compiled this information by reviewing federal reports. While some of the data is several-years old; it’s apparently the most recent available.

The FBI spent an average of $42 million a year on confidential human sources between fiscal years 2012 and 2018. “Long term” informants comprised 20 percent of its intelligence relationships (source: DOJ IG 2019 report).

The ATF employed 1,855 informants who were paid $4.3 million annually (FY2012-2015). Therefore, on average, each informant made $2,318 for the year. (source: DOJ IG report 2017).

DEA Employed 18,000 Informants, Some Earning Up To $1 Million

Each year, thousands of confidential human sources are on the payroll.

“One federal agency, the DEA, had over 18,000 active confidential sources assigned to its domestic offices, with over 9,000 of those sources receiving approximately $237 million in payments for information or services they provided to the DEA” (between Oct. 1, 2010 and Sept. 30, 2015, source: 2016 DOJ IG report).

High-earning informants included an “airline employee who received more than $600,000 in less than four-years, and a parcel employee who received over $1 million in five-years.” The Inspector General at Justice who scrutinized DEA informants reported the findings.

“During this audit, we found that, between FYs 2011 and 2015, the DEA actually used at least 33 Amtrak employees and eight TSA employees as sources, paying the Amtrak employees over $1.5 million and the TSA employees over $94,000.”

One Amtrak employee was paid $962,615 between 2010 and 2015 to be a confidential source, which the IG called “a substantial waste of government funds.” The information provided “could have been obtained by DEA at no cost through a joint task force with the Amtrak Police.”

While certain informants were becoming federally-minted millionaires, the  average DEA informant made much less – approximately $26,333 over a recent five-year period.

And it appears there may be corruption, in addition to crime, in the system. In 2017, during a Congressional Oversight Committee hearing on confidential informants, then-Chairman Rep. Jason Chaffetz (R-UT) noted:

“a court released the testimony of one confidential informant in Atlanta who received $212,000 from the DEA from 2011 to 2013. She testified she wasn’t sure why she was paid. That was her testimony. She also testified to a sexual relationship with the DEA group supervisor, who allegedly convinced the subordinates to falsify reports to justify the payments. That case is currently under review by the inspector general.”

Authorizing “Crimes” by Informants— The DOJ Guidelines

Federal informants often commit crimes, and often do it with the permission of their federal handlers, according to a 2015 audit by the General Accountability Office (GAO). In fact, the GAO reports:

 “Since 1980, the Guidelines have permitted agencies to authorize informants to engage in activities that would otherwise constitute crimes under federal, state, or local law if someone without such authorization engaged in these same activities. For example, in the appropriate circumstance, an agency could authorize an informant to purchase illegal drugs from someone who is the target of a drug-trafficking investigation. Such conduct is termed “otherwise illegal activity.”

“The Guidelines include certain requirements when authorizing otherwise illegal activity and restrictions on the types of activities an agency can authorize. In particular, the Guidelines prohibit agencies from authorizing an informant to participate in an act of violence, obstruction of justice, and other enumerated unlawful activities.”

According to Freedom of Information Act documents obtained by the Daily Dot, “In total, records obtained by reporters confirm the FBI authorized at least 22,823 crimes between 2011 and 2014.”

Here are two examples of where the FBI has employed confidential human sources in controversial roles:

Governor Whitmer Kidnapping Plot Case Clouded by Informants’ Roles

In court proceedings, the feds have shared the identification numbers of 12 confidential informants involved in Michigan Governor Gretchen Whitmer’s kidnapping plot, but refused to provide recruitments methods, payments, locations, and names for all but one.

In October 2020, Justice announced the arrest of six men who were said to be conspiring over a six-month period to kidnap Governor Whitmer. Eight others were charged under Michigan’s anti-terrorism statutes for providing material support to the plotters.

However, as BuzzFeed News reported,

“some of those informants, acting under the direction of the FBI, played a far larger role than has previously been reported. Working in secret, they did more than just passively observe and report on the actions of the suspects. Instead, they had a hand in nearly every aspect of the alleged plot, starting with its inception. The extent of their involvement raises questions as to whether there would have even been a conspiracy without them.”

In September, a federal judge delayed the case of the five defendants who have pled not-guilty, after their defense lawyers asked for more time to investigate the informant aspect of the case.

January 6th Capitol Riot Had At Least Two Embedded FBI Informants

In September, the New York Times reported a bit of a bombshell: at least two informants embedded with the U.S. Capitol crowd were in close contact with their FBI handlers on January 6th.

As reporter Julie Kelly at American Greatness details it, an “informant, according to ‘confidential documents’ furnished to the paper, started working with the FBI in July 2020 and was in close contact with his FBI handler before, during, and after the Capitol protest.”

In recent Congressional testimony, Rep. Thomas Massie (R-KY) played a video montage of a man encouraging election protestors to go into the Capitol on January 6th. Rep. Massie asked Attorney General Merrick Garland if the man was an FBI agent-provocateur.

Garland refused to comment on an ongoing investigation. Many suspect the man was working with federal authorities before, during, and after the events of January 6th at the U.S. Capitol Building. He, apparently, has not been arrested or charged.

US Seeks Balance as Fears Grow Russia May Invade Ukraine

WASHINGTON (AP) — The buildup of Russian troops near Ukraine has left U.S. officials perplexed, muddying the Biden administration’s response.

Some Republican lawmakers have been pressing the U.S. to step up military support for Ukraine. But that risks turning what may be mere muscle-flexing by Russian President Vladimir Putin into a full-blown confrontation that only adds to the peril for Ukraine and could trigger an energy crisis in Europe.

But a weak U.S. response carries its own risks. It could embolden Putin to take more aggressive steps against Ukraine as fears grow he could try to seize more of its territory. And it could cause more political damage for President Joe Biden at a time his popularity is dropping.

Knowing how to strike the right balance would be easier if the U.S. had a better understanding of what Putin was trying to accomplish. But top officials admit they don’t know.

“We’re not sure exactly what Mr. Putin is up to,” Defense Secretary Lloyd Austin said Wednesday. A week earlier, Secretary of State Antony Blinken said, “We don’t have clarity into Moscow’s intentions, but we do know its playbook."

Rep. Mike Quigley, an Illinois Democrat and member of the House Intelligence Committee, said better understanding Putin’s intentions was critical “to avoid the mistakes that have started great wars.”

Any U.S. response must be calibrated to avoid being "an appeaser or a provocateur,” he said.

“This is a tough, tough area to try to gain information,” he said. “It’s a challenge that’s as tough or tougher than it’s ever been. It has a pretty serious impact on our ability to make the correct decisions.”

Russia seized Ukraine's Crimean Peninsula in 2014 and an ongoing conflict in eastern Ukraine between Kyiv and Russian-backed rebels in the region known as Donbas has left an estimated 14,000 dead. Now, Ukraine says an estimated 90,000 Russian troops have massed near the border.

The buildup could be a prelude to another Russian invasion. Speaking to Ukraine's foreign minister this month, Blinken said Putin's “playbook” was for Russia to build up forces near the border and then invade, “claiming falsely that it was provoked."

NATO Secretary-General Jens Stoltenberg said Friday that the alliance is seeing an “unusual concentration” of Russian forces along Ukraine's border, warning that the same type of forces was used by Moscow in the past to intervene in neighboring countries.

Though U.S. officials don't believe an invasion is imminent, Putin also has ramped up his dismissal of an independent Ukraine. A lengthy essay the Kremlin published in July asserts that Ukrainians and Russians are “one people” and the “true sovereignty of Ukraine is possible only in partnership with Russia.”

But the moves could also be saber-rattling to prevent Ukraine from growing closer to the West or being admitted into the North Atlantic Treaty Organization, which Putin strongly opposes. It’s not clear if Russia would risk invading Ukraine, setting off a far more difficult war, or want to occupy hostile territory.

A similar Russian military buildup in the spring did not lead to an invasion, though lawmakers and officials say they are more concerned now, citing U.S. intelligence that has not been made public.

Russia denies it has aggressive motives, insisting it is responding to increased NATO activity near its borders and the strengthening of Ukraine's military.

Speaking on Thursday, Putin said, “It should be taken into consideration that Western partners are exacerbating the situation by supplying lethal modern arms to Kyiv and carrying out provocative military maneuvers in the Black Sea — and not only in the Black Sea but also in other regions close to our borders.”

The U.S. has sent ships into the Black Sea as part of NATO activity alongside Ukraine and in recent weeks has delivered military equipment as part of a $60 million package announced in September. Since 2014, the U.S. has committed to spending more than $2.5 billion to help Ukraine strengthen its defense.

The White House said it hopes to de-escalate tensions. “As we have made clear in the past, escalatory or aggressive actions by Russia would be of great concern to the United States,” a spokesperson for the National Security Council said in a statement.

There has been a flurry of diplomacy in recent weeks. U.S. leaders have met with their Russian and Ukrainian counterparts, including a visit by CIA Director William Burns to Moscow during which he spoke to Putin by phone. Germany and France have issued a joint statement affirming support for Ukraine.

Ultimately, the U.S. has few good apparent options to stop Putin were he to press forward.

The Biden administration in April imposed new sanctions on Russia for what it said was Russia’s role in the Ukraine conflict as well as allegations that it has abetted cyberattacks on U.S. infrastructure and interference in American elections.

Imposing more sanctions is unlikely to influence Putin’s behavior, lawmakers and experts said. The Biden administration in May did waive sanctions related to the Nord Stream 2 pipeline, which will carry Russian natural gas directly to Germany, bypassing Ukraine.

A group of Republican lawmakers this month called on the U.S. to provide more lethal aid to Ukraine’s military, ramp up intelligence sharing, or deploy a larger presence of its own to the Black Sea. But Russia could quickly counter with more forces.

And Putin could respond to any Western action by limiting energy exports to Europe, which is heavily dependent on Russian natural gas.

“The traditional tools that nation-states use to govern behavior of other nation-states are not available,” said Douglas Wise, a former deputy director of the Defense Intelligence Agency. “The Russians have very little at risk.”

Writing for the Carnegie Endowment for International Peace, two analysts said Putin may want to send a message to Washington that it must treat Russia “as a major power that cannot be marginalized on the U.S. agenda.” But the analysts also described Ukraine as Putin’s “unfinished business."

“That piece of unfinished business is the restoration of Russia’s dominion over key parts of its historic empire,” Eugene Rumer and Andrew Weiss wrote. “No item on that agenda is more important — or more pivotal — than the return of Ukraine to the fold.”

Trying to seize more of Ukraine — or even pushing to Kyiv — would be much tougher than taking Crimea or parts of eastern Ukraine, said Paul Kolbe, a former CIA officer who leads the Intelligence Project at Harvard University’s Belfer Center.

Putin can achieve many of his objectives without an invasion, Kolbe said, by putting pressure on Ukraine and NATO and driving a wedge between allies about how to respond.

“It’s fitting in with a larger pattern of ensuring from their perception that they don’t face threats on their close borders,” he said.

Такое мнение высказал бывший помощник президента РФ Владислав Сурков в опубликованной в субботу на портале "Актуальные комментарии" статье "Куда делся хаос? Распаковка стабильности".

"<...> В начале [XXI] века российская система власти остановила лавину социального хаоса и вытащила травмированную страну из-под завалов перестройки. Двадцать лет стабильности, которых не хватило Столыпину, теперь у нас есть. И еще будут. Вертикаль, порядок и скрепы гарантированы. Эти годы, точно, когда-нибудь станут вспоминать как золотой век", - считает Сурков.

Он, однако, напомнил о физическом законе возрастания энтропии в замкнутой системе и поставил вопрос о том, "где теперь хаос, которого вроде нигде не видно". Сурков сделал вывод, что "хаос уходит в слепые зоны общественной жизни". "Люди не хотят быть против. Люди хотят быть параллельно, не пересекаясь с системой без крайней нужды", - полагает экс-чиновник. По мнению Суркова, прямой угрозы это не представляет, "система как никогда, слава богу, прочна". Но и игнорировать данную проблему, как считает автор статьи, неразумно: в качестве примера он привел конец 1980-х, когда "все пошло не по плану". Идею же "либеральных экспериментов" для "выпуска пара" экс-чиновник считает рискованной, так как "разгерметизация системы <...> способна привести к необратимой дестабилизации".

Сурков заключил, что социальную энтропию нужно "выносить куда-нибудь подальше", "экспортировать для утилизации на чужой территории".

Раздел сфер влияния

Он в связи с этим подчеркнул, что "экспорт хаоса дело не новое" и "все империи делают это". "На протяжении веков Русское государство с его суровым и малоподвижным политическим интерьером сохранялось исключительно благодаря неустанному стремлению за собственные пределы", - пишет Сурков. По его мнению, "жалобы Брюсселя и Вашингтона на вмешательство Москвы, невозможность урегулирования значимых конфликтов по всему земному шару без российского участия показывают", что Россия не утратила имперских инстинктов.

При этом "крупнейшим поставщиком разнообразных беспорядков на мировой политический рынок" бывший помощник президента РФ назвал Соединенные Штаты Америки. Что касается Евросоюза, то, по мнению Суркова, это объединение "в перспективе может быть как источником хаоса, так и его абсорбентом", причем "последнее представляется более вероятным".

Сурков считает, что "выбросы социальной энтропии" больших государств можно контролировать так же, как парниковые выбросы, однако вопрос в том, как сильно должны обостриться геополитические разногласия, чтобы "сверхдержавы выработали новый порядок сосуществования".

"Как бы то ни было, необходим очередной раздел сфер влияния. И он (рано или поздно, формально или неформально, тайно или явно) обязательно состоится. Вопрос лишь в том, какой ценой", - полагает Сурков. По его словам, разделение на сферы влияния необходимо, чтобы избежать столкновений потоков социального хаоса из политических систем крупных стран. По мнению автора, на следующем историческом цикле "Россия получит свою долю в новом всемирном собирании земель (вернее, пространств), подтвердив свой статус одного из немногих глобализаторов, как бывало в эпохи Третьего Рима или Третьего Интернационала".

"Россия будет расширяться не потому, что это хорошо, и не потому, что это плохо, а потому что это физика", - полагает бывший помощник президента.

О Суркове

Сурков с 1999 года по 2011 год в разное время занимал посты замглавы Администрации президента РФ, замруководителя администрации - помощника главы государства и первого замглавы администрации Кремля. В 2011-2013 годах он работал на посту вице-премьера, а затем с 2013 года по начало 2020 года вновь занимал пост помощника президента.

Сурков является автором ряда публицистических статей, ставших предметом широкого общественного обсуждения. В частности, в ноябре 2006 года при описании российской политической системы он использовал термин "суверенная демократия", противопоставив его "управляемой демократии" - политическому режиму, управляемому, по его мнению, извне.

Куда делся хаос? Распаковка стабильности

Ни одна система не содержит в себе доказательства собственной истинности. Всякая система включает в себя элементы самоотрицания и саморазрушения. Так или примерно так говорили Гегель и Гёдель. Оба, каждый по-своему, один математически, другой на языке философии указывали на неустранимые нестыковки в человеческой логике, через которые непрерывно и неостановимо происходит утечка гармонии и смысла из нашего повседневного существования.

То же самое, но уже применительно к физическим процессам утверждали многочисленные соавторы второго закона термодинамики. В самом деле, вульгарный пересказ этого закона, ставший настоящим мегахитом научпопа, гласит: энтропия в замкнутой системе возрастает. Иными словами, хаоса (беспорядка) никогда не становится меньше. Наоборот, его практически всегда становится больше. И соответственно, всюду наблюдается хроническая убыль порядка и стабильности на фоне прогрессирующих турбулентностей и распада.

Второй закон термодинамики, предсказывая неизбежность «тепловой смерти Вселенной» и конечного торжества хаоса, превращает пессимизм из «плохого настроения» в научно обоснованную доктрину. И опережает по влиянию на охотно унывающую часть человечества не только книгу Екклесиаст, но и классическую сентенцию капитана Лебядкина «самовар кипел с восьмого часу, но...потух...как и все в мире. И солнце, говорят, потухнет в свою очередь...» Не все, однако, склонны к унынию. Социальная физика и политическая динамика предлагают свой рецепт для наведения и поддержания мирового порядка — сильнодействующую государственность. Да, государство, как его ни назови (аппаратом насилия или общественным договором, любезным отечеством или сворой бюрократов), прежде всего является инструментом снижения социальной энтропии. При этом второй закон термодинамики никто не отменял — и любое государство рано или поздно изнашивается и гибнет в борьбе с «многомятежными хотениями» собственных граждан. Впрочем, какое-то и часто довольно длительное время государство может быть эффективным.

Так, в начале века российская система власти остановила лавину социального хаоса и вытащила травмированную страну из-под завалов перестройки. Двадцать лет стабильности, которых не хватило Столыпину, теперь у нас есть. И еще будут. Вертикаль, порядок и скрепы гарантированы. Эти годы, точно, когда-нибудь станут вспоминать как золотой век. Но.

Но если второй закон термодинамики верен (а он верен) и энтропия не может уменьшаться и исчезать, то возникает вопрос (довольно тревожный вопрос) — где она в таком случае? Когда порядок навели, что стало с беспорядком? Где теперь хаос, которого вроде нигде не видно? Куда он делся? В каких местах он теперь растет (он ведь «по закону» должен расти!)?

Еще недавно прибежищем хаоса и канализацией свободы был интернет. Его восхваляли как прекрасную анархию не от мира сего, где все дозволено и где всем от вседозволенности хорошо. Почему-то тогда забывалось, что вообще-то заказчиком и разработчиком интернета является Пентагон. И было бы странно ожидать, чтобы это вполне военное ведомство, по определению предназначенное для насаждения дисциплины и контроля, причем методами всеми возможными, вплоть до массовых убийств, вдруг озаботилось созданием продукта для «нашей и вашей свободы». Оно и не озаботилось. Если рассуждать о свободе, равенстве, братстве..., то интернет, очевидно, не из этой продуктовой линейки. А из другой, пентагоновской: MQ-9, Stuxnet, F-35... В итоге в Сеть пришли с обысками полицейские всех стран, вскрики юзеров «это был не я, это все моя аватарка» в качестве оправдания не принимаются, и призрачные чертоги виртуальной вольности на глазах изумленной публики уже обретают строгие очертания цифрового концлагеря.

Методично вытесняемый из обеих реальностей (материальной и виртуальной) хаос уходит в слепые зоны общественной жизни. Он стимулирует стихийное распространение неафишируемых коллективных практик, направленных не против мейнстрима, а параллельно ему. Люди не хотят быть против. Люди хотят быть параллельно, не пересекаясь с системой без крайней нужды. Массовая дисполитизация населения оставляет истэблишмент наедине с самим собой. Для параллельных людей сходить на выборы или пронести правильный плакат — не более, чем способ по-быстрому отдать кесарю кесарево, чтобы потом вернуться обратно в свою личную недовселенную, где они обитают в полном несоответствии с духом и буквой этого плаката. Широкое распространение такой точечной лояльности и одноразового патриотизма означает, что во все более монолитной с виду структуре общества образуется все больше лакун и полостей, заполняющихся неизвестно чем.

Когда правильные слова от слишком частого повторения плавно обессмысливаются, из них испаряется искренность, и символ веры превращается в банальный пароль для получения доступа к системе распределения должностей и привилегий. И тогда существенным становится не то, что люди говорят, а то, о чем они молчат. Господствующий дискурс утрачивает убедительность и все чаще нуждается в силовой поддержке. А несвоевременные и потому невыговариваемые мысли, идеи и сомнения наполняют молчание завораживающей многозначительностью. В каком-то смысле молчание становится альтернативной идеологией. И это тоже симптом накопления иррегулярности.

Прямой угрозы для установленного порядка перешедший в режим молчания и параллельной общественности беспорядок не представляет. Система как никогда, слава богу, прочна, и хаос для нее не проблема. Галопирующая централизация остается генеральным трендом. Применение экстрактов исторической памяти, просроченной морали, административно-духовных ценностей и других тяжелых социальных консервантов в неограниченных дозах обеспечивает сохранение желанной стабильности.

И все же игнорировать «непроблему» неразумно. Идеология молчания тем и неприятна, что не проговорена, а значит, не структурирована, темна и бессвязна. Если (пусть и нескоро) приходит ее время, она тупо обрушивается на существующий порядок вещей, не формулируя внятных целей. Когда в конце 80-х молчаливое большинство выманили на политическую арену, никто не смог разобрать, чего же оно на самом деле хочет — «да как же тебя понять, коль ты ничего не говоришь?» Когда же народ попытались «разговорить», то наслушались от него такого, что только диву дались и вконец запутались. В результате запутавшееся руководство Советского Союза открыло беспорядочный «огонь по штабам» и устоям. И все пошло не по плану. Потому что под носом у ЦК и Госплана безмолвно созрело какое-то незапланированное, несоветское, непонятное и неожиданно залихватское общество, готовое при первой же возможности бессмысленно и беспощадно пуститься во все тяжкие. Чем кончилось, известно.

То, что в теории энтропия имеет свойство нарастать именно в замкнутых, закрытых системах, вроде бы подсказывает простое решение проблемы — открыть систему, «выпустить пар», и хаос отступит. Но эта простота обманчива. Либеральные эксперименты на внутриполитическом блоке ставить крайне рискованно. Разгерметизация системы, этого хорошо работающего сегодня «социального реактора» чревата неконтролируемыми выбросами гражданского раздражения и способна привести к необратимой дестабилизации — смотрим примеры из 80-х и 90-х.

Социальная энтропия очень токсична. Работать с ней в наших домашних условиях не рекомендуется. Ее нужно выносить куда-нибудь подальше. Экспортировать для утилизации на чужой территории.

Экспорт хаоса дело не новое. «Разделяй и властвуй» — древний рецепт. Разделение — синоним хаотизации. Сплачивай своих+разобщай чужих=будешь править и теми, и другими. Разрядка внутренней напряженности (которую Лев Гумилев расплывчато называл пассионарностью) через внешнюю экспансию. Римляне делали это. Все империи делают это. На протяжении веков Русское государство с его суровым и малоподвижным политическим интерьером сохранялось исключительно благодаря неустанному стремлению за собственные пределы. Оно давно разучилось, а скорее всего, никогда и не умело выживать другими способами. Для России постоянное расширение не просто одна из идей, а подлинный экзистенциал нашего исторического бытия.

Имперские технологии эффективны и сегодня, когда империи переименованы в сверхдержавы. Крымский консенсус — яркий пример консолидации общества за счет хаотизации соседней страны. Жалобы Брюсселя и Вашингтона на вмешательство Москвы, невозможность урегулирования значимых конфликтов по всему земному шару без российского участия показывают, что наше государство не утратило имперских инстинктов.

Крупнейшим поставщиком разнообразных беспорядков на мировой политический рынок являются, впрочем, США. Надо отметить (не без удивления), что фирменная американская нестабильность очень рентабельна и пользуется феноменальным спросом. Дикую разбалансированность своего сюрреалистического бюджета Штаты компенсируют иррациональной эмиссией доллара, который уже давно не столько деньги, сколько единица измерения финансовой энтропии, вирус хаоса, разносящий по всей планете пандемию экономических пузырей, дисбалансов и диспропорций. Экспорт «цветных» революций и назидательных войн, как бы приостановленный, мгновенно возобновится, стоит только потенциальным импортерам хоть немного расслабиться. Экспериментальная этика made in USA проносится бурей по головам африканцев, азиатов и наших евразиатов, потрясая нетренированные умы традиционалистов. Возмущение, отчасти наигранное, с которым ее у нас встречают, кажется оборотной стороной острого любопытства и лишь подтверждает, что она обладает сильной прилипчивостью в сочетании с мощным деформирующим эффектом.

Китайская сдержанность маскирует гигантские резервы хаоса, накопленные дисциплинированной нацией. Если приложить ухо к Великой Стене, можно услышать, как у них закипает. Когда внутренние противоречия Поднебесной перельются через край, она превратится в важнейшего эмитента энтропии, оспорив и по этой теме американское лидерство. Пекин все круче возвышается над миром, и геополитическая обстановка многим народам напоминает жизнь в окрестностях Везувия: все хорошо, но когда начнется извержение Китая, кто станет Помпеями? Евросоюз, находящийся в странном квантовом состоянии то ли все еще становления, то ли уже распада, в перспективе может быть как источником хаоса, так и его абсорбентом. Последнее представляется более вероятным, по крайней мере, на ближние времена благодаря рыхлой и отменно бестолковой структуре еврократического правления. Если так пойдет и дальше, то ЕС станет процветающим полигоном для утилизации политического мусора, куда бродяги и шпионы со всей планеты натащат гнилых избытков классовой и расовой вражды.

Выбросы социальной энтропии политическими системами больших государств так же, как выбросы их экономиками двуокиси углерода, в принципе можно контролировать. Но как далеко должны зайти климатические изменения, чтобы нации договорились по-настоящему, как быть с парниковыми газами? И до какой степени должны обостриться геополитические разногласия, чтобы сверхдержавы выработали новый порядок сосуществования? Исторические примеры неутешительны: и Мюнстерские договоренности, и Венский конгресс, и Ялтинская конференция стали возможны и успешны лишь после того, как хаос достиг уровня ада. Как бы то ни было, необходим очередной раздел сфер влияния. И он (рано или поздно, формально или неформально, тайно или явно) обязательно состоится. Вопрос лишь в том, какой ценой. С точки зрения социальной физики сфера влияния это ограниченное договором пространство для рассеивания и утилизации хаоса, вытесняемого из стабильной политической системы. Если договора нет, турбулентные потоки, образуемые суперстранами, начинают сталкиваться между собой, порождая разрушительные геополитические штормы. Чтобы избежать таких столкновений, нужно направить каждый поток в отдельное русло.

А пока что мир наслаждается своей многомногополярностью, парадом постсоветских национализмов и суверенитетов. Но в следующем историческом цикле забытые сегодня глобализация и интернационализация вернутся и накроют это сумеречное Многополярье. И Россия получит свою долю в новом всемирном собирании земель (вернее, пространств), подтвердив свой статус одного из немногих глобализаторов, как бывало в эпохи Третьего Рима или Третьего Интернационала.

Россия будет расширяться не потому, что это хорошо, и не потому, что это плохо, а потому что это физика.

the multi-functional tool of authoritarian regimes

A method reminiscent of the Cold War. All over the world, associations, independent media outlets and NGOs - all which often constitute the last critical bulwark against totalitarian abuses - are facing new laws aimed at curbing their activities by depriving them of means, and at discrediting them. In most cases, this roots from the genuine paranoia of closed political regimes and their leaders when faced with organisations that they suspect of serving the interests of foreign powers, or of political opponents in exile.

The practice is not new, it originated in the United States. From 1938 onwards, the American authorities became obsessed with the idea of a Nazi, and then Soviet, fifth column operating within their territory. In 1938, Washington passed a law imposing strict controls on NGOs working in the country which received foreign funds and carried out "political activities". McCarthyism in the 1950s, in a context of East-West opposition, naturally aggravated this situation. The result was an exacerbated ideological propaganda campaign which for a long time paralysed many American NGOs, relegating them to the rank of "foreign agents". As the saying goes: "Give a dog a bad name and hang him", many activists lost their freedom for their defence of civil rights or trade unions.

The Russian laboratory

Since the Cold War, many regimes have taken up this authoritarian approach against civil society and the media in their countries, such as Greece under the Colonels.More recently, Ethiopia, adopted a repressive law that paralysed the activities of a large number of human rights NGOs which received foreign funding between 2009 and 2019. But, above all, in a reversal of historical trends, it was Vladimir Putin who most notably revived these measures in the early 2010s to attack NGOs working in Russia. As early as 2012, legislative measures mentioned the established term "foreign agents", to implicate those suspected of carrying out an activity considered as "political" and in favour of differing interests. This loose and expandable definition consists of those wanting to influence government decision-making in order to change state policy. It is an interpretation that targets the very functioning of many civil society organisations. Often, it is the source of an organisation’s donations and funding that is singled out to claim its affiliation with the "enemy".

Thus, the simple fact of wanting - for example - to re-establish a historical truth, or to defend the rights of LGBT people, can lead to being labelled as an agent in the service of foreign powers, naturally hostile to the Kremlin’s policies. Several Russian NGOs have been prosecuted under this legislation, and some have been forced to disband. FIDH’s member organisation in Russia, Memorial Human Rights Centre, for example, is regularly confronted with this.

In another category, some institutions, such as the former Perm 36 Museum which denounced the crimes of the Soviet regime, was itself declared a “foreign agent". Following an administrative closure, it was ultimately taken over by the regime and more or less wiped out.

Since 2014, no less than seven legislative amendments have further restricted the ability of Russian NGOs to act. This includes the obligation to register with the authorities, a law that since 2017 has targeted the media, activists and independent journalists. Since April 2021, the Riga-based Russian and English language news website Meduza, for example, has been one of the main targets on the list of "foreign agents". Four months later, the independent television channel Dojd and the investigative journalism website IStories were also placed on the list of news or analysis sites that are termed "foreign agents", joining the Sova centre, which focuses on issues of nationalism and xenophobia, and has been on the list since December 2016. Independent journalist organisations have also been targeted. In August 2021, the Union of Freelance Journalists of the Perm region Chetvjortyj Sektor was added to the register. This legislative and judicial relentlessness, aimed at stifling any opposition, leaves no leeway for civil society or political opposition.

Nationalist and xenophobic rhetoric

This draconian approach has now been extended to target ordinary citizens guilty of "political activity" on social media, and who since 2020 are also at risk of being prosecuted as "foreign agents". Anyone who directly or indirectly receives financial or methodological support from abroad can fall into this category.

The trend has spread around the world. For example, in the former provinces of the Soviet Union which are still under Moscow’s influence, such as Azerbaijan, Kyrgyzstan, where a draft law was finally abandoned in 2016, or Ukraine, where similar legislative proposals are under discussion. But also in Israel, and even within the European Union (Hungary, Bulgaria, Poland, etc.), where the rise of ultra-conservative populism has encouraged the adoption of such draconian measures. In Latin America, too, the simplicity, effectiveness and even popularity of this repressive system, which plays on nationalism and xenophobia, has greatly seduced certain regimes. The same terminology and procedures are used to restrict the activities of civil society and NGOs, all in the name of fighting against foreign influence.

An example is Venezuela, where a "Law on International Cooperation" has been discussed several times, with the aim of controlling the funds that Venezuelan civil society organisations can access. Although this law has not been approved, it is currently on the agenda of the National Assembly, elected in December 2020. In the meantime, the Venezuelan government has been imposing strict control measures on non-governmental organisations on the basis of the "Law against Organised Crime and Terrorist Financing". The administrative decision approved on 3 May 2021 obliges, for example, all non-profit organisations - including individuals and legal entities - to register with the National Office against Organised Crime and the Financing of Terrorism (ONCDOTF), before they can operate. These organisations must provide information about their domestic or foreign funders, as well as a list of allied organisations abroad with which they have agreed to collaborate.These conditions affect their access to funding and criminalise Venezuelan civil society organisations and their allied partner organisations in the country.

“In Nicaragua, the enemy from within”

In this Central American state, the exploitation of "laws against foreign agents" seems to be reaching a climax. April 18th, 2018 marks a shift in Nicaragua towards an even more authoritarian regime. The State’s position is based on the systematic denial of the existence of attacks and harassment against human rights defenders and political opponents. Furthermore, the government justifies its own attacks by labelling organisations as "promoters of violence". These justifications support a narrative of there being a permanent risk of a "coup d’état", allegedly being plotted by human rights defenders and political opposition.

Within this context, between October 2020 and January 2021, several laws and a constitutional reform were passed by the Ortega-Murillo regime, threatening the fundamental rights and freedoms of Nicaraguan civil society. These laws particularly target individuals, human rights organisations, and notably journalists: the law on the regulation of foreign agents, the special law on cybercrime, the reform of Article 37 of the Constitution on life imprisonment, and the law for the defence of the people’s rights to independence, sovereignty and self-determination for peace. These laws contravene international human rights laws and provide dangerous and additional repressive tools. They underscore the notion of an ’enemy within’, whereby human rights defenders are labelled as ’traitors’ and ’enemies of the homeland’. The result is their increasing degree of isolation and lack of resources and protection from persecution by the state apparatus.

Moreover, since June 2021, civil society has lived in fear of raids and arbitrary detentions. Several of its representatives have already been detained by the Nicaraguan authorities and investigated under "Law 1055 of 2020", the reform of the Penal Code and "Law 1040 on the regulation of foreign agents". References to "foreign agents" and "cybercrimes" are clearly used in an arbitrary manner to criminalise any form of opposition. They allow for the closure of media outlets and hinder the work of NGOs by limiting access to funding for defenders, all of whom are labelled as "foreign agents" or "terrorists". At least two recognised civil society organisations have decided to suspend their activities as a result of these draconian laws: Fundación Violeta Chamorro and Pen International. In such a context, with no opposition and no respect for human rights, one can certainly no longer speak of democracy in Managua.

David against Goliath

FIDH’s members and partners are included in the many human rights organisations targeted around the world. We fight every year to help them overcome the legislative and material obstacles which hinder their actions. We provide them with legal assistance, and alert international bodies of their situation. We also lobby for the adoption of laws to safeguard the independence of civil society, and to create an appropriate environment for their activities. Sometimes this activism pays off: recently the European Court of Human Rights ruled that Hungary’s anti-NGO law was a clear violation of fundamental rights.

But often, taking action is tantamount to the fight between David and Goliath. Our organisations are increasingly accused of being "enemies guided by the outside", with a "political agenda" of removing leaders or influencing people against the "values" defended by the ruling power (religious, communist, nationalist, conservative, etc.).
Despite all our advocacy efforts, totalitarian, authoritarian or semi-democratic regimes, now "financed" and protected even within the United Nations human rights bodies by states such as Russia or China, are increasingly succeeding in silencing their civil society by depicting the most threatening NGOs as harmful foreign bodies that need to be monitored or even eradicated.

A race against time

This strategy even inspires states that are radically opposed to the international scene, such as Iran and Israel, united by their development of similar regulations, practices and/or narratives to stigmatise the alleged activities of "foreign agents". In countries where they can defend themselves, NGOs waste precious time in long and costly procedures to register or justify the source of their funding. This wastes energy that could be used by them to carry out their missions. Elsewhere, laws and charges against "foreign agents" pave the way for the persecution of human rights defenders.

This map is not exhaustive, but it shows you the danger of these practices and laws and their extent. It demonstrates the need to combat them, so that organisations working for the common good can continue to do so in complete freedom. It is not inevitable that these practices will spread like a bad spy novel: we need everyone’s support to design an alternative, inclusive, and truly human rights-based future.

Zakharova commented on the suspension of the work of the Russian KSORS in the USA

The Coordinating Council of Organizations of Russian Compatriots in the United States (KSORS) suspended its work due to pressure from the American special services. As noted by the official representative of the Russian Foreign Ministry, Maria Zakharova, the council's activities do not violate the laws of the United States.

“On November 18, the Coordinating Council of Organizations of Russian Compatriots in the United States (KSORS) was forced to suspend its public work due to tough and unprecedented pressure from American intelligence services,” a statement on the website of the Russian Foreign Ministry said.

It is noted that these actions violate the legal rights of the Russian diaspora to preserve their national cultural identity.

Zakharova added that for several years the FBI had threatened the members of the KSORS with criminal prosecution for allegedly failing to comply with the American law on foreign agents.

"The legitimate humanitarian activities of the KSORS, carried out on the principles of openness and cooperation, do not violate American law and are not subject to the said law," the Russian Foreign Ministry said.

Earlier, the Russian Embassy in Washington demanded that the United States stop persecuting the Russian diaspora.

The Russian Embassy in Washington turned to the American side with a demand to stop the persecution of the Russian diaspora in the United States. This is stated on the Facebook page of the diplomatic service.
 
On the eve of the Coordinating Council of Organizations of Russian Compatriots in the United States (KSORS) announced the suspension of work in connection with the FBI investigation. About 300 representatives of the Russian diaspora were interrogated.
 
The embassy assessed the corresponding actions as unfriendly towards Russia. Russian diplomats were outraged by the "hostile actions of the United States" against the Russians under the pretext of suspicion of working in the United States without registering as foreign agents.
 
“The reason is the unprecedented pressure on the representatives of the Russian-speaking community by the American authorities that has been continuing for a number of years,” follows from the message.
 
It is noted that the FBI officers sometimes rudely conducted searches and interrogations of representatives of the diaspora, confiscated personal belongings. 
 
“Thus, the US authorities are denying immigrants from Russia the right to maintain contact with their historical homeland, to take an active part in preserving their own cultural and linguistic heritage,” the office stressed.

According to the statement of diplomats, compatriots are trying to strengthen mutual understanding between Russians and Americans, to contribute to the normalization of bilateral ties.

Earlier it was reported that Washington is delaying the extension of visas for almost 60 employees of the Russian Embassy and Consulates General in the United States, and about 40 more employees are awaiting entry permits in Moscow.
