Supreme Court Rules Trump’s Taxes May Be Released To Grand Jury

New York Times report detailing President Donald Trump's tax situation has raised serious questions for one the world's largest banks, Deutsche Bank, a major Trump creditor.

Deutsche Bank loaned Trump more than $2 billion over the course of two decades, at a time when other banks appeared unwilling to do so, according to an earlier Times report in February. The revelation that the president hasn't paid any federal income tax in 10 of the last 15 years has many demanding answers.

Trump's critics are pointing to the fact that Justin Kennedy, son of retired Supreme Court Justice Anthony Kennedy, was global head of the real-estate capital markets division at the bank and became close with the future president while continuing to lend him money. Kennedy worked at Deutsche Bank's U.S. branch from 1998 to 2009.

"If I were Deutsche Bank executives who gave loans to Trump when no one else would, Including Anthony Kennedy's son, I would be very, very nervous right now," tweeted Norman Ornstein, resident scholar at the conservative American Enterprise Institute.

The recent New York Times report claimed that Trump paid just $750 in federal income taxes in 2016 and again in 2017. These claims are yet to be independently corroborated.

This has raised further questions about his credit worthiness and his vulnerability to foreign influence.

"Substantial personal debt is one of the most common reasons security clearances are denied, because it's so easily exploited or leveraged by foreign intelligence services," said former Missouri Secretary of State Jason Kander.

A White House whistleblower claimed in 2019 that the president's daughter and son-in-law, Ivanka Trump and Jared Kushner, were granted security clearances over the objections of officials who feared they were susceptible to foreign influence, financial problems and a slew of other issues.

The president's critics have also pointed to recent claims by Andrew Weissman, the lead prosecutor in Special Counsel Robert Mueller's investigation of the Trump campaign's alleged ties to Russia.

In 2017, the Mueller team issued subpoenas to Deutsche Bank for information about Paul Manafort's income. Manafort had served as chair of Trump's campaign and was later convicted of tax fraud as a result of Mueller's probe.

The White House reportedly found out about the secret subpoenas and demanded answers from the Special Counsel's office. Mueller's deputy, Aaron M. Zebley, was authorized to tell the White House they were not investigating the president's finances.

"At that point, any financial investigation of Trump was put on hold," Weissman wrote in his book, Where Law Ends: Inside the Mueller Investigation. "That is, we backed down—the issue was simply too incendiary; the risk, too severe."

The New York Times has said it will publish more information in the coming weeks but questions are already mounting for Trump and Deutsche Bank. The connection to Justice Anthony Kennedy's son and Manafort's dealings with the bank are likely to come under greater scrutiny as November 3 approaches.

A wind-driven wildfire erupted on Sunday in the heart of northern California’s Napa Valley wine country to spread across nearly 809 hectares, forcing the evacuation of a hospital and hundreds of homes, authorities said. 

Fire crews were out in force, scrambling to fend off flames threatening neighborhoods and vineyards at the northern end of the famed wine-growing valley and surrounding hillsides, about 120 kilometers north of San Francisco. 

The blaze, dubbed the Glass Fire, broke out before dawn near Calistoga and raced toward the adjacent communities of Deer Park and St. Helena, with flames reaching within a mile of the Adventist Health St. Helena hospital. 

All 55 patients there at the time were safely evacuated by ambulance and helicopter over the course of five hours from about 7 a.m., hospital spokeswoman Linda Williams told Reuters.  

“We had ambulances lined up from all over the Bay area,” she said, adding that although smoke shrouded the facility, the skies above were clear enough for helicopters’ airlift efforts. 

It was the second wildfire-related evacuation of the 151-bed hospital in a month, after a massive cluster of lightning-sparked blazes that swept several counties north of the San Francisco Bay region in August. 

Authorities ordered about 600 homes evacuated on Sunday, with residents of 1,400 more warned to be ready to flee at a moment’s notice, said Tyree Zander, a spokesman for the state’s forestry and fire protection department (CalFire). The notices affected at least 5,000 people, he added. 

By evening, flames stoked by winds gusting up to 80 kph had scorched about 728 hectares of grassy rolling hillsides and oak woodlands, with little or no containment, Zander said.   

Fire at harvest time

The cause of the fire is being investigated. There were no immediate reports of injuries, but a Reuters photographer in St. Helena saw some structures that had been burned. 

The blaze erupted midway through the traditional grape-harvesting period in the Napa Valley, world renowned as one of California’s premiere wine-producing regions. The area’s 475 wineries account for just 4% of the state’s total annual grape harvest but half of the retail value of all California wines sold, according to the Napa Valley Vintners trade group. 

Of Napa’s 16 wine-growing districts, or sub-appellations, the Howell Mountain area may have faced the greatest threat, said Lisa Covey, a spokeswoman for Hall Family Wines, which kept open during the day all its three tasting rooms in the county. 

Napa and other wine-growing regions have been hit by wildfires in and around the Bay area for several years. Susan Krausz, co-owner of Arkenstone Estate Vineyards in the Howell Mountain community of Angwin, said it would take days or weeks to assess the impact of the latest blaze on valley vintners. 

“Most people have harvested,” she said, but added, “Any time’s a bad time for a fire.” 

Tom Kaljian, 78, a realtor who owns a house about halfway between Calistoga and St. Helena, defied evacuation orders to spend the day with his wife hosing down their home and dry brush along a fence line separating their property from the Silverado Trail, a key north-south roadway. 

“We were told to get out of here, but I was trying to protect our little abode, so we stayed,” he told Reuters by telephone. 

After firefighters told him the house was no longer in danger, he added, “I stopped watering at that point, and came in and took a nap.” 

The Glass Fire came as the Pacific Gas and Electric Company said it was temporarily halting power to transmission lines in parts of 16 counties across northern and central California to guard against greater wildfire risks in hot, windy, dry weather. 

The public safety power shutoffs were expected to affect about 65,000 regional homes and businesses, said PG&E, the state’s largest electric utility. 

A red flag warning for extreme wildfire risks for Napa Valley would run through Monday morning, Zander said. 

CalFire said a fire weather watch would start on Monday across much of Southern California, following the forecast return of hot, gusty Santa Ana winds and low humidity. 

California wildfires have scorched more than 1.5 million hectares in the first nine months of 2020, far exceeding any single year in state history, killing 26 people and destroying more than 7,000 structures.

The world is rapidly approaching a death toll of one million from COVID-19, the John Hopkins Coronavirus Resource Center reported early Monday. Hopkins said there are more than 33 million COVID-19 infections around the globe. 

A CNN investigation of Hopkins data reveals the number of COVID-19 cases has increased by at least 10% from the previous week in 21 U.S. states.  

Dr. Chris Murray, director of the Institute for Health Metrics and Evaluation at the University of Washington told CNN an expected huge surge in coronavirus infections in October in the U.S. is also expected to continue in November and December.

The U.S. has more than seven million COVID-19 infections, followed by India with over six million and Brazil with nearly five million, according to Hopkins data. 

Europe is experiencing a new wave of coronavirus infections, leading some governments across the continent to reimpose restrictions on residents and businesses. 

British Prime Minister Boris Johnson is warning that his country could see a second wave of the coronavirus.  He said Sunday that swift and decisive action must be taken to battle the virus that causes COVID-19. 

In France, Patrick Bouet , the head of the National Council of the Order of Doctors, told Journal du Dimanche that if nothing changes, France will face a widespread outbreak across its whole territory, for several long autumn and winter months and the health system would crumble under the demands.  

Dutch Prime Minister Make Rutte called the wave of infections in his country very worrisome and will force us to take extra measures. 

In Spain, local Madrid authorities and the national government are clashing over the extent of the steps needed to control the outbreak of new infections in the capital region.

Facebooks deletion of accounts targeting the Philippines from bases in China shows that the U.S. internet giant wants a better reputation in Southeast Asia after letting things slide in the past, say analysts who follow the case. 

On September 22, Facebook said it had removed 155 of its own accounts and six Instagram accounts for violating an internal policy against foreign or government interference which is coordinated inauthentic behavior on behalf of a foreign or government entity. The accounts originated in China and focused primarily on the Philippines and Southeast Asia more broadly as well as on the United States, Facebook says. 

Facebooks move will endear it to Filipinos, who use the service so fervently that it has become a de facto official homepage for businesses and government agencies but who also worry that it has become too permissive, scholars say.    

For Facebook, its more from a kind of a PR point of view I do this at a particular time, somehow, its seen as positive and I can say, look, I have done this, said James Gomez, regional director at the Bangkok-based think tank Asia Center. 

Operators of the deleted accounts had posted in Chinese, English and Tagalog about naval activity in the South China Sea as well as Philippine politics and tried to cover up their identities, Facebook said.  

China and the Philippines dispute sovereignty over a tract of the sea thats rich in fisheries as well as undersea energy reserves. China has the upper hand militarily, frustrating officials in Manila and fanning debate there over whether the Philippines should ask Washington for more help. 

The connection to Facebook goes back to 2015, when the California-based service joined domestic mobile service provider Smart Communications to offer an app that allowed free access to 24 heavily used mobile sites.

But Facebook has made eyes roll in the Philippines and other Southeast Asian countries by allowing relatively unfettered access by politicians, hate-speech spreaders and purveyors of fake news, Gomez said.   

We would welcome that there is self-governance on the part of Facebook, said Ramon Casiple, executive director of the Metro Manila-based advocacy group Institute for Political and Electoral Reform. There was a lot of that [problematic material] in the past up till now. 

Philippine President Rodrigo Duterte maintains an online army that was reportedly paid to pack Facebook with supportive material in the name of grassroots activists, Southeast Asian news outlet New Mandala reported in 2017, a year after Duterte took office.   

Filipinos are starting now to eye the 2022 presidential election, motivating Facebook to clean up so it can avoid criticism, said Eduardo Araral, a Filipino and associate professor at the National University of Singapore’s public policy school.  

Some of the shuttered accounts carried content supportive of President Rodrigo Duterte and Sara Dutertes potential run in the 2022 Presidential election, Facebook said, referring to the current leaders daughter. Presidents can serve just one term in the Philippines. 

They have to be active in showing Facebook is no longer used or can no longer be used as a platform for inauthentic behavior, Araral said. 

Duterte has pursued friendship with China despite the maritime dispute, but common Filipinos remain leery of Beijings designs for the surrounding seas. 

About 74 million people use Facebook in the Philippines, where the total population stands near 109 million. Facebooks statement says 276,000 accounts followed one or more or 11 deleted Facebook Pages belonging to businesses. The service took down those pages along with the 155 non-business accounts. Facebook said that about 5,500 people followed one of more of the closed-down Instagram accounts. 

Facebook has removed accounts in Singapore and Myanmar as well, as both countries approached political milestones, Gomez said.  

In 2018, for example, a U.N. Office of the High Commissioner for Human Rights mission found that Facebook had helped spread hate speech against the Rohingya, a Muslim minority in Myanmar that has struggled to get along with the countrys government. Facebook took down a page authored by senior Myanmar military officials — a long-time nemesis of the Rohingya — after the U.N. findings appeared.

U.S. Democratic presidential candidate Joe Biden called Sunday for the Republican-controlled Senate to delay confirmation of President Donald Trumps Supreme Court nominee, saying voters are not going to stand for this abuse of power. 

Biden said the Senate should delay action until after he or Trump is inaugurated in January for a new four-year term. But Trump has said that moving forward with his choice of Judge Amy Coney Barrett is his constitutional duty, even though no Supreme Court nominee has ever been put forth so close to a presidential election.

Bidens comments come as Democrats and Republicans moved to use the Supreme Court vacancy left by the death of Justice Ruth Bader Ginsburg to energize voters in the Nov. 3 election.

“The Senate has to stand strong for our democracy,” Biden said at a brief news conference in his home state of Delaware. He said the Senate moving ahead on the Barrett nomination would be an irreversible step toward the brink. And a betrayal of a single quality that America is born and built on: The people decide.  

Should he win the election, Biden said the Barrett nomination should be withdrawn so he can make a pick.

But Trump, after nominating Barrett, a staunch conservative appellate court judge, on Saturday, told the Fox & Friends show that he thinks she can be confirmed before the vote, saying there is a tremendous amount of time. 

“I think we could have it done easily before the election,” Trump said, adding that Republicans, with a 53-47 Senate majority are “going to try and have it done quickly. 

“I think she’ll be confirmed […] relatively long before the election,” Trump said, although an initial timetable laid out by Republican senators does not call for a final vote on her confirmation until late October, in the week before the election.

Trump announced Barretts nomination Saturday. He has said she is needed on the court to fill the seat held by Ginsburg, a liberal icon, so that in case of election disputes, there would be a full complement of nine justices to avoid potential 4-4 votes. 

Barrett, with a lifetime appointment, would increase the courts current 5-3 conservative majority to 6-3. Now 48, she would be the youngest justice on the court.

Democrats have accused the president of trying to set the stage for a disputed election, in part by suggesting with scant evidence that widespread use of mail-in voting because of the coronavirus pandemic opens the door to fraud. 

But rather than focus on her possible role in deciding an election dispute, Biden said a Justice Barrett could immediately threaten health care benefits for millions.

Thats because a week after the election, on November 10, the court is slated to hear arguments on a new challenge to the Affordable Care Act, the national health care law popularly known as Obamacare that was enacted in 2010 when then-President Barack Obama led the country and Biden was his vice president.

The Supreme Court, in another challenge to the health care law, narrowly upheld its constitutionality in 2012, with Chief Justice John Roberts casting the deciding vote. In a law review article before she was named for a judgeship by Trump in 2017, Barrett criticized Roberts reasoning. As such, some court analysts believe she would vote to overturn the law.

In a New York Times/Sienna College poll taken Sept. 22-24, 56% of those surveyed said they would like to see the winner of the election make the Supreme Court pick. And 41% said Trump should make the appointment. The national survey has a 3.5 percentage point margin for error.

In his news conference, Biden said Barretts nomination is about peoples health care in the middle of a pandemic, referring to the coronavirus that, according to the Johns Hopkins University, has killed more than 204,000 people in the United States, more than any other country.

Despite Bidens plea that the Senate must not act on this nomination, there is no indication that Republicans intend to delay the confirmation process.
